Albert Powell is an attorney in the New York office of Constantine Cannon. Mr. Powell joined the firm in January 2006 and concentrates his practice on antitrust litigation.
Mr. Powell is currently representing Discover Financial Services, Inc. in its lawsuit against Visa and MasterCard for damages due to the associations "exclusionary rules" which prohibited banks in the United States from issuing Discover credit and debit cards. Prior to joining Constantine Cannon, Mr. Powell was an associate with the largest plaintiff law firm in the United States. During his years there, Mr. Powell focused on the prosecution of class and complex action in many fields of commercial litigation, including the areas of securities, insurance, and antitrust litigation. Mr. Powell served as a class counsel in the landmark In Re Visa Check/MasterMoney Antitrust Litigation. Mr. Powell worked almost exclusively on this matter for over four years. He was involved in fact discovery, depositions, and participated in the final preparation for trial. The case was successfully settled on the eve-of- trial on behalf of over five million merchants for $3.4 billion and unprecedented injunctive relief for class members in April 2003. The following year, Mr. Powell was a member of the plaintiff trial team in In Re Raytheon Securities Litigation. The parties settled this securities fraud litigation on the eve-of-trial for a First Circuit record of a combined $460 million in May 2004. Mr. Powell also worked extensively on the following cases: Duhaime v. Hancock (represented life insurance policyholders defrauded by "vanishing premium" and other improper sales tactics) (settled for $350 million in December 1997); In Re Charter Communications Securities Litigation (settled for $146 million in June 2005); and J.E Pierce v. Harvard Pilgrim Health Care, 365 F. Supp. 2d 119 (D. Mass. 2005) (represented Massachusetts independent pharmacies that were allowed summary judgment against defendants, including an HMO and a large national drugstore chain, for violating Mass. unfair trade practices law). Mr. Powell is a graduate of Columbia University and the University of Texas School of Law. He is admitted to practice in New York and Connecticut, and before the United States District Courts for the Southern and Eastern Districts of New York. Mr. Powell resides in Brooklyn with his wife and daughter. |
