Michelle A. Peters is Senior Staff Counsel at Constantine Cannon, and has practiced with the firm since February 2000. Michelle's concentration lies primarily in the areas of antitrust litigation and compliance, and general commercial litigation, and she has extensive experience in the payment systems industry.

Most notably, she is a member of the team of lead counsel that represents Wal-Mart, Sears, The Limited, Safeway, Circuit City, and three merchant trade associations on behalf of a certified class of more than five million U.S. merchants, in the case captioned In re Visa Check/MasterMoney Antitrust Litigation. Throughout the litigation, she worked closely with managing partner, Lloyd Constantine, in drafting and preparing for oral arguments and opening statements, coordinating evidentiary support for focus groups, mock trial and trial, and participating at counsel's table during oral arguments concerning class certification, summary judgment, and settlement approval. The case has successfully resulted in an historic $3.05 billion antitrust settlement and injunction on behalf of U.S. merchants, and Michelle currently assists in facilitating the administration of settlement funds allocation to class members, and in investigating and overseeing continuing settlement compliance efforts.

She also currently represents such clients as Morgan Stanley, Discover Financial Services, Inc., and The News Corporation Limited.

Michelle has extensive legal research experience in federal and state antitrust law, commercial law, and consumer protection law, and federal civil and appellate practice and procedure. She is consistently called upon by the firm as the "go to" fact finder, and her writing experience includes drafting pleadings, legal memoranda, discovery requests and responses, and FOIA requests.

Michelle graduated cum laude from the Syracuse University College of Law in 1999, and received a Certificate of Specialization from the Family Law and Social Policy Center. During law school, she was a member of the Women's Law Caucus, the Family Law Society, and the Law Student Senate, from which she was awarded a Senate Citation for service. As a student attorney in her law school's Children's Rights and Family Law Clinic, Michelle successfully represented children and their families in child custody and support, school discipline, and special education cases, and appeared on behalf of clients in family court and at school district hearings.

In 1996, Michelle graduated cum laude from the University of Delaware in the top 5% of her class, with a major in Criminal Justice and a minor in Psychology. She was awarded Dean's List status every semester, as well as membership in the Alpha Kappa Delta Honor Society and the Phi Kappa Phi Honor Society.

Michelle was admitted to practice in January 2000 before the Bar of the State of New York. She is also a member of the Bars of the United States District Courts for the Eastern and Southern Districts of New York. In addition, she is a member of the American Bar Association and the New York State Bar Association, and is a member of the ABA's Antitrust Section.
