Amy N. Roth is Senior Staff Counsel with the law firm of Constantine Cannon. Ms. Roth has been an attorney with the firm since 1997. She currently works in the Washington, D.C. office. Ms. Roth has experience in the areas of antitrust and complex commercial litigation as well as antitrust compliance, including representation of clients before the U.S. Department of Justice in connection with the merger review process.

Major cases litigated by Ms. Roth at Constantine Cannon include:

  • In Re Visa Check/MasterMoney Antitrust Litigation, representing Wal-Mart, Sears, The Limited, Safeway, and Circuit City, three major merchant trade associations and a class of 5 million U.S. merchants in this historic antitrust class action against Visa and MasterCard. The case settled in the spring of 2003 for $3.05 billion and unprecedented injunctive relief. Ms. Roth participated extensively in all phases of the litigation. Notably, Ms. Roth managed the team of attorneys and paralegals responsible for organization of the case's massive discovery record throughout all stages of the litigation up until the settlement. She currently is one of the attorneys responsible for administering the plan of allocation, under which class members will receive their portion of the settlement fund.

  • Seton Company v. Lear Corporation, representing Seton Company at trial in its breach of contract action against Lear. A jury awarded Seton $30 million in damages.

  • United States v. Primestar, representing The News Corporation Limited in the Department of Justice's investigation and suit to block the sale of direct broadcast satellite assets.

  • Kesmai Corporation v. America Online, Inc., representing The News Corporation Limited's subsidiary Kesmai in an antitrust and fraud action against America Online.

Prior to joining Constantine Cannon, Ms. Roth was a contract attorney with Weil, Gotshal & Manges, retained for the regulatory agency review of the Nynex and Bell Atlantic merger.

Ms. Roth received her J.D. from New York Law School. During law school, Ms. Roth represented a Haitian immigrant seeking permanent asylum while participating in her law school's Civil Law Clinic. She also was an Urban Corps (now known as Public Service Corps) Intern at New York City's Bureau of Equal Employment Opportunity. Ms. Roth obtained her B.A. from the State University of New York at Binghamton, where she was a Friar's Foundation Scholarship recipient. Before beginning her legal career, Ms. Roth worked in a number of media-related fields.

Ms. Roth is a member of the bars of the State of New York, District of Columbia, and the federal district courts for the Eastern and Southern Districts of New York. Ms. Roth has contributed to the state antitrust law section of Legal Aspects of Selling and Buying, a leading antitrust treatise.
